Every user of Medianis is obligated to become familiar with the Agreement stipulations and sign the approval of them in the registration form!
THE SUBJECT
Item 1.
In this agreement the Provider and the User define their mutual relationship regarding Internet services usage via “dial-in” connection, which is established through a modem and existing phone line between the User`s computer and the Provider`s server.
THE PROVIDER`S OBLIGATIONS
Item 2.
The Provider is obligated to enable standard Internet services usage to the User in the following way:
- to provide and place standard Internet services at the User`s disposal,
- to provide a phone connection by means of which the User is allowed an Internet access to dial-in services,
- to provide the space on the server for a mail-box and personal web site of the User, in accordance with the Provider`s technical conditions stated in the Agreement and registration form,
- to inform the User in a wriiten form, immediately after the User`s registration, about the way of connecting the User`s computer, technical parametres and their implementation, as well as the phone numbers to be used for dial-in connection to the Provider,
- to activate the User`s account at most in 24 hours after the User`s registration and account payment and to fulfill all other administrative and technical activities prescribed by the Agreement,
- to follow constantly the realization of the User`s account and inform the User by e-mail or at the Provider`s web site about all the changes in conditions of service functioning, as well as all problems that might have an impact on the realization of obligations stipulated by the Agreement,
- to warn the User about the expiration of an hour package and to maintain the inactive account untill the next extension, but no longer than 30 days from the account `locking`,
- to keep in secrecy the User`s data, messages and documents and not to violate them,
- to inform the User on time about servicing activities or other works on the network as well as the network failure and failure duration,
- to monitor the User`s activities and behaviour in accordance with the Codex on Internet Behaviour, (which is an inseparable part of the Agreement) in order to prevent the so-called. "forbidden behaviour " of the User (FBU) and eliminate them for the reasons of protecting other Users of Internet services,
- to place responsibility on the User who attemps `forbidden behaviour`, from their disrupting from the network to bringing criminal charges against them, obliging them at the same time to compensate for the damage caused by such behaviour.
THE USER`S OBLIGATIONS
Item 3.
The User is obligated, in order to achieve an optimal level of Internet services usage,
- to provide the computer equipment, a modem and phone line in accordance with the minimal technical conditions defined by the Provider,
- to register and pay for the service usage to the Provider (which consists of the amount for an hour package on the Internet) in accordance with the Price List and procedure prescribed,
- to do the equipment set-up and create an internet connection in accordance with the Provider`s instructions,
- to monitor the status of a hour package usage on the Internet, pay for the account extension and inform the Provider about it before the previous extension expiration,
- to activate an Internet package in 30 days from the account `locking`,
- to keep the secrecy of their password and other data stated in the User`s Account, and give them only to an authorized person/administrator from the Provider`s technical support, on condition that their identity is ascertained,
- to use Internet services in a way that is not opposed to legal rules of the country, international law, codexes and instructions about which they are properly informed by the Provider,
- not to disturb by their behaviour the privacy and activities of other Users on the Internet, and especially:
- not to distribute unwanted e-mail messages or "spam" other users by sending the same messages to a great number of addresses on the internet,
- not to access unauthorizedly and not to disturb the functioning of certain internet systems,
- not to violate an undisturbed network functioning of the Provider or any network on the Internet,
- to compensate for any damage caused to the Provider, other Users and third parties, defined by legal procedure of the authorities,
- not to authorize third parties for the User`s rights and obligations.
THE PROVIDER`S RESPONSIBILITY LIMITATION
Item 4.
The Provider is not responsible for:
- problems in phone line functioning leased from PTT, on condition that they are caused by reasons out of the Provider`s control, works by PTT or other reasons that cannnot be seen to by the Provider,
- problems in Internet functioning caused by reasons out of the Provider`s responsibility,
- security, data and other information validity from the Internet that are available to the User,
- damage caused by personal data disclosure of the User`s account by the User themselves,
- privacy violation of the User caused by FB of third parties,
- privacy violation of the third parties caused by FBU,
- all other kinds of damages caused by FBU.
OTHER STIPULATIONS
Item 5.
The Provider has a right to change unilaterally the commercial conditions of Internet packages and other services usage which are the subject of the Agreement, as well as other stipulations of the Agreement, with duty to inform the User in a proper way. Price change does not relate to a previously purchased Internet package.
Item 6.
Informing the User in an appropriate way means that there is information announced on the Provider`s web site, or sent by e-mail, telefax or letter. Information sent by e-mail is considered to be sent to the User from the moment it is delivered to the User`s mail box on the Provider`s server.
Item 7.
Inseparable parts of the Agreement are the specification of technical conditons and the Codex on Internet behaviour available to every User on the Provider`s web site.
Item 8.
Every contracting party has a right to a unilateral break of the Agreement, without having to ask for another contracting party`s permission. Mutual obligations of the Provider and the User become invalid from the moment of an hour package expiration, except in cases of the Agreement break due to FBU.
Item 9.
In case of a dispute that cannot be solved by mutual agreement, the contracting parties have to accept a legal authority of the court of Nis.
Item 10.
This Agreement is enforced from the moment of its appearance on The Provider`s web site and is obligatory for all Users of Internet services who have an active account with the Provider.
